Terms and Conditions
Before you start using metroBlog services, you must read and accept the following terms and conditions (T&C) of our site, as well as review them regularly for any amendments that may be applied to them.
1 – ACCEPTANCE OF TERMS. – metroBlog shall provide its services according to the following Terms and Conditions (hereinafter called “T&C”), which may be updated or amended by metroBlog from time to time. You can check the most recent version of our T&C at any time you wish, just accessing the site. Due to the services we provide, we are subject to the compliance of these T&C. This is why your access to metroBlog and its links and services indicates your express acceptance of these T&C. If you are using any specific service provided metroBlog you shall be subject to the guidelines or rules of use applicable to those services, which may be published or modified periodically by metroBlog. All of the guidelines or rules of use are incorporated by reference in our T&C.
2 – USER LIBILITY. – As a user of our Service, you shall be liable to: (a) Provide correct, accurate, updated and complete information about yourself in the way requested in the Service registering form (such information shall be hereinafter called “Registration Data”) and (b) Maintain and update in a constant manner your Registration Data so that they can be accurately stored. If the user has provided incorrect, inaccurate, outdated or incomplete information or if metroBlog has considered, at his sole discretion, that such information is not correct, accurate, updated or complete, metroBlog shall be entitled to cancel the user’s account and interrupt his or her activities.
3 – PRIVACY POLICY. – Users’ Registration Data and any other type of private information belonging to them that they have expressly chosen not to display to the community are subject to complete privacy and their use is limited to their sole belonging to metroBlog users’ database. metroBlog reserves the right to send occasional e-mail messages in accordance with this privacy policy.
4 – USER’S ACCOUNT, PASSWORD AND SECURITY. – Users are bound to: (a) notify metroBlog immediately when they find out about any unauthorized use of their password or account or any other type of security failure and (b) make sure their account is logged out at the end of each session. metroBlog shall not be liable for any loss or damage resulting as a consequence of the user’s non-compliance with the provisions herein defined.
5 – USER CONDUCT. – Users accept and agree that all of the information and content provided are the sole responsibility of the user who has provided them. Taken that every user is responsible for the content they send, under no circumstances shall metroBlog be responsible for any content, including but not limited to, errors or omissions or loss or damages resulting from the use of these contents. Users shall warrant metroBlog that they will not use the service to: (a) e-mail or publish within the BLOG any content that is considered illegal, dangerous, threatening, abusive, harassing, tortuous, libelous, vulgar, obscene, slandering, which violates the right to privacy, disgusting, discriminatory or otherwise offensive to third parties; (b) cause any damage to minors; (c) impersonate anyone or any entity, including, but not limited to, a metroBlog officer or employee; or make any false statements or otherwise deceive about their partnership with any person or entity; (d) interfere or interrupt the Service, servers or nets linked to the Service; (e) violate, either intentionally or not, a local, national or international law; (f) threaten or otherwise harass third parties; or (g) store or save personal data about other users. The Service is suitable for use for people over thirteen (13) years old. metroBlog reserves the right to reject the use of the service to any person at any time without prior notice, no matter the reason.
6 – DISCLOSURE OF INFORMATION. – The user accepts and agrees that metroBlog can retain and disclose the Content if so requested by law or if, in good faith, metroBlog considers that such preservation or disclosure is necessary for: (a) complying with legal provisions; (b) enforcing the T&C; (C) responding to claims about any content violating third party’s rights; or (d) protecting the rights, property or personal security of metroBlog, its users or the general public. The user also accepts that the technical processing and the transmission of the Service, including its content, may involve: (a) transmissions via various nets; and (b) changes for the adjustment and adaptation to the requirements of nets or connection devices.
7 – SPECIAL WARNINGS FOR INTERNAL USE. – Due to the global nature of the Internet, the user understands and complies with all local, state, federal or international regulations regarding online conduct and acceptable content.
8 – PUBLIC CONTENT DISPLAYED IN metroBlog. – (a) within the T&C section, the “areas of public access to the Service” are those whose access is open to the general public. (b) When the user chooses to display certain Content in metroBlog’s public access areas, he thereby grants metroBlog a non-exclusive international license to reproduce, translate, create works derived from it, distribute, execute and display such Content (completely or partially) worldwide and incorporate it to other works in any way, media or technology, either known or to be developed in the future.
9 – INDEMNITY. – Users are bound to indemnify (including reasonable attorneys’ fees) and hold harmless metroBlog, as well as its subsidiaries, shareholders, officers, agents, representatives, related parties and employees regarding any claims or lawsuits, filed by third parties in relation to the Content or arising out of the presentation, display, or transmission of the Content through our Service, the users’ connection to the Service, their violation of the T&C or their violation to third parties’ rights.
10 – PROHIBITION ON SERVICE RESALE. – Users are bound not to reproduce, duplicate, copy, sell, resell or exploit with any commercial purpose any part of the Service, use of the Service or Content provided during such use.
11 – GENERAL PRACTICE ABOUT metroBlog’s EMAIL USE AND WITHHOLDING. – Users acknowledge and agree that metroBlog may establish general practices and restrictions regarding the use of the Service, including but not limited to, the maximum number of days that e-mail messages can be withheld by the Service, the maximum number of e-mail messages that can be sent or received by an account within the Service, the maximum size of any –email message that can be sent or received by an account within the Service, the maximum disk space that shall be assigned in metroBlog’s servers for the user’s benefit and the maximum number of times (including their maximum duration) that the user may access the Service during a specific period of time. On account of the aforementioned, metroBlog shall not be liable nor legally responsible for the deletion or failure while saving messages or other types of communications or any other Content held in or transmitted by the Service. metroBlog therefore reserves the right to remove those accounts that have been inactive during an extended period of time and modify these general practices and restrictions from time to time.
12 – MODIFICATIONS TO THE SERVICE. – metroBlog is entitled to modify or discontinue the Service or any part of it, temporarily or permanently, at any time an periodically. metroBlog shall therefore not be liable towards users or third parties for any modification, discontinuation or interruption of the Service.
13 – TERMINATION. – Users acknowledge and agree that metroBlog is entitled to cancel or suspend their passwords, accounts (or any part of them) or their use of the Service at any time and remove and discard any Content within the Service for any reason, including but not limited to, users’ inactivity or if metroBlog considers that a user has violated or acted against the content or the ideas behind the T&C. On account of the aforementioned, users accept that metroBlog is entitled to disable or immediately delete their account and all the related information and files and deny the access to those files or to the Service if the user does not comply with or violates what has been stated in these T&C. In these cases, metroBlog shall not therefore be liable towards users or third parties for any termination of their access to the Service.
14 – LINKS. – The Service itself or third parties may provide links to other sites over which metroBlog has no control, so users accept and agree that metroBlog shall not be liable for those external sites and resources. metroBlog neither supports them nor is responsible nor has any legal responsibility for the Content, marketing, products offered in the sites or which may be available for users from those sites or resources. Additionally, users accept and acknowledge that metroBlog shall not be liable nor shall it be bound, directly or indirectly, to compensate for any damages originating from the use of or credibility in any Content, goods and services available from any external sites or resources.
15 – COPYRIGHT. – All the content created by metroBlog, its partners or suppliers and included in this site, such as texts, logos, graphic design, images, JavaScript code, HTML code and other type of software is property of metroBlog.com (or of its partners or suppliers) and is protected by international intellectual property legislation. The compilation (including collection, management and set-up) of all the content within this site is exclusive property of metroBlog.com and is protected by international intellectual property legislation. The content and software contained in this site may be used as home pages or as a web-surfing resource. Any other use, including the reproduction, modification, distribution, transmission, re-edition or display of this site’s content is strictly prohibited.
16 – TRADEMARKS. – metroBlog is a registered trademark. This trademark shall not be used in relation to any product or service not belonging to metroBlog or to any of its partners, neither in a way that may bring about confusing situations among customers nor in any other way that may dishonor or discredit metroBlog.
17 - LIMITATION OF WARRANTY. – Users accept and acknowledge that: (a) the use of the Service is at their own risk. The Service is provided by metroBlog as available, thus metroBlog does not provide warranties of any kind express or implied, including, without limitation, the implied warranty of merchantability, fitness for a particular purpose and non-violation of user systems. (b) metroBlog does not warrant that (i) the Service shall suit the requirements of the user; (c) the Service shall be uninterrupted, punctual, secure or error-free; (iii) the results obtained as a consequence of the use of the Service shall be correct or reliable; and (v) every error in the software shall be rectified. (c) Any material downloaded by users or otherwise obtained through the use of the Service is obtained at the users’ sole discretion and risk and they shall be liable for any damages caused to their computer or net connection system or for any loss of data arising out of downloading any of these materials. (d) No suggestion or information, either oral or written, obtained by the user from metroBlog or through the use of the Service shall constitute a warranty, unless expressly established within the T&C.
18 – DISCLAIMER OF LIABILITY FOR DAMAGES. –This site is provided by metroBlog.com in a “as is” basis. metroBlog does not therefore grant any warranty, either express or implicit, regarding the site operation, or the information, content, materials or products therein contained. To the fullest extent permitted by law, metroBlog.com disclaims any warranty, either express or implicit. metroBlog.com shall not be liable for any damage of any kind which may arise from any person using this site, including but not limited to, direct, indirect, incidental or consequential damages.
19 - APPLICABLE LAW. – This site is created and monitored by metroBlog.com in Buenos Aires, Argentina. Therefore, the disclaimer of liability and the terms and conditions shall be governed by the Argentine legislation, disregarding any principle pertaining to conflicts of legislation. We reserve the right to make any changes in our site, in the disclaimer of liability clause and in the T&C at any time.
20 – VIOLATIONS. – In the event that a user identifies any violation of the T&C by any third party, he or she shall inform it to our technical staff as soon as possible.
Entire Agreement. This Agreement represents the entire agreement between the user and metroBlog. This Agreement rules the use of the Service and supersedes any previous understandings or agreements between the user and metroBlog.
Waiver and independence of conditions. The fact of metroBlog not complying with nor granting warranty about any right or provision of these service Conditions shall not constitute a waiver to such right or provision. If a court having the corresponding jurisdiction considers any clause of the service Conditions not valid, the parties agree that such court shall interpret and construe each party’s intentions in accordance with the contents of the provision. The rest of the provisions shall remain in full force and effect.
